Plea deals are dependent on the case. But, it is true that most drug-related cases are settled with plea deals. In fact, most criminal cases are settled with plea deals. Almost universally, you will wind up with a better result if you enter a plea than if you are convicted and sentenced after a trial. Preparing a case to show the prosecutor why the charges should be reduced as low as possible is what involves most of the defense attorney’s work. Sometimes, we can even get a disposition which results in the complete dismissal of the charge after a period of time, or after completing a certain drug program. Again, there’s no one-size-fits-all. It depends on the particular case. A good experienced attorney is going to know how to exploit all of the things that are good about your case and get you the best possible outcome.
That’s a question that only an attorney who has a lot of experience can answer. There’s no one simple answer. It’s a question of figuring out what is best for the client. There are cases where I would tell a client that the chances of winning the case are extremely good, but the offer is not all that great and the best option is to fight it out in court. If I do that, I will explain to the client exactly what is good about the case, and why I think the case should go forward to trial. At the same time, I will tell a client that no matter how strong your case is, there is always the possibility of being wrong and getting convicted. And sometimes, the possible punishment related to going to trial is so severe and extreme that the defendant will choose to take a disposition, even though the chances of winning are very good. You don’t want to take the risk of having your life totally ruined by a very long sentence. Again, every case is different. Your attorney, if he or she knows what they’re doing, should be able to explain all your options and secure those options. That way, you know what your chances are if you go to trial. Your attorney should also aggressively work toward the best possible plea offer. By working together with the client, you can make the ultimate decision of whether or not to proceed to trial, or whether the best option is taking a plea.
